Design4nails LTD Affiliate Program Terms and Conditions

Section 1. General Provisions

1. These Terms and Conditions (hereinafter referred to as the “Terms”) govern the operation of the Affiliate Program of the online store Design4nails LTD (hereinafter referred to as the “Store”), available at www.design4nails.co.uk.
2. The Affiliate Program is organised by Design4nails LTD, registered at 89 Bassett Street, LE35ED Leicester, United Kingdom, Company Number 11729184 (hereinafter referred to as the “Organiser”).
3. The Affiliate Program (hereinafter referred to as the “Program”) aims to promote the Store’s products through a referral system implemented by Program participants (hereinafter referred to as “Participants” or “Affiliates”).
4. Participation in the Program is voluntary and requires acceptance of these Terms.

Section 2. Participation Requirements

1. Any adult individual or entity conducting business activities may become a Participant by registering for the Program via the form available on www.design4nails.co.uk in the “Affiliate” section.
2. Registration requires providing accurate personal details (full name, email address) and agreeing to these Terms.
3. The Organiser reserves the right to verify Participant data and refuse participation in the Program without providing a reason.

Section 3. Program Rules

1. Upon registration, the Participant receives a unique referral code (hereinafter referred to as the “Code”), which they may share with others (hereinafter referred to as “Buyers”).
2. A Buyer using the Code when placing an order in the Store receives a one-time discount of 5% on the basket value.
3. The Participant earns a commission of 5% of the value of each order placed using their Code, after deducting the discount granted to the Buyer. The commission is provided in the form of a discount voucher (hereinafter referred to as the “Voucher”) redeemable at the Store on www.design4nails.co.uk.
4. The Voucher’s value equals the commission amount and can be used for purchases in the Store without a minimum order value.
5. The Voucher is valid for 90 days from the date of issuance. Unused Vouchers expire after this period.
6. Full statistics (number of referred orders, commission value, available Vouchers) are accessible to the Participant upon logging into the “Affiliate” section on www.design4nails.co.uk.

Section 4. Commission Conditions

1. Commission is awarded only for orders that are paid and fulfilled (not subject to returns).
2. If a Buyer returns an order, the commission for that order will not be awarded, or if already awarded, the Organiser may cancel the Voucher.
3. Commission is not awarded for orders placed by the Participant using their own Code.
4. The Organiser reserves the right to withhold or cancel commission in cases of breach of these Terms or illegal activities (e.g., spam, fraud).

Section 5. Participant Obligations

1. The Participant agrees to promote the Store in a manner consistent with the law, ethical standards, and good practices.
2. The following is prohibited:
   
   • Using the Code in a misleading manner (e.g., impersonating the Store),
   • Distributing the Code via spam,
3. The Participant is responsible for the content of promotional materials related to the Program.

Section 6. Organiser’s Rights and Obligations

1. The Organiser provides the Participant with access to the Code and statistics in the “Affiliate” section on www.design4nails.co.uk.
2. The Organiser reserves the right to:
   
   • Amend the Program rules with 14 days’ prior notice to Participants,
   • Terminate the Program at any time with 30 days’ notice,
   • Refuse or revoke a Participant’s involvement in case of breach of these Terms.
3. The Organiser is not liable for losses incurred by the Participant in connection with participation in the Program.

Section 7. Data Protection

1. The data controller of Participants’ personal data is Design4nails LTD.
2. Personal data is processed for the purpose of running the Program in accordance with the Store’s Privacy Policy, available at https://www.design4nails.co.uk/terms-of-service-and-privacy-policy/www.design4nails.co.uk/privacy-policy .
3. Participants have the right to access, correct, and delete their data in accordance with applicable regulations, including the UK GDPR.

Section 8. Complaints

1. Any complaints related to the Program should be submitted to info@design4nails.co.uk within 14 days of the incident.
2. The Organiser will respond to complaints within 14 working days of receipt.

Section 9. Final Provisions

1. These Terms take effect on 5 March 2025 and remain in force until further notice.
2. Matters not covered by these Terms are governed by the laws of England and Wales.
3. Acceptance of these Terms constitutes agreement to its conditions and participation in the Program.
