Terms and conditions

1. Ordering

 1.1 Ordering from Design4nails is very easy and simple.  From the comfort of your own home browse through our catalog and just choose the products you would like to purchase. After that add them one by one to the shopping cart.

1.2 Once you have finished choosing the products you would like, it is time to pay for them.  Simply click on “Checkout” and that will take you to another page where you will be presented with the total amount to be paid. Just type in your shipping details and then click the relevant button to pay for your items. It really is as easy as that.

2. Payment methods

2.1 We accept online payment methods via PayPal, Klarna, ClearPay, LayBuy, and card payments.

2.2 There may be some surcharge for using your credit card to make purchases. Please be sure to provide your exact billing address and telephone number (i.e. the address and phone number your credit card bank has on file for you). Incorrect information will cause a delay or even decline your payment. Your credit card will be billed upon shipment of your order.

2.3 All payments made to Design4nails are in GBP currency.

2.4  Cheques are not acceptable.

3. Shipping policy

3.1 We will dispatch your order asap but not longer than 2 working days. Orders are not processed or shipped on Saturday, Sunday, or Bank Holidays, except by prior arrangement.

3.2 Orders placed on Friday after 11:00 AM will be processed on Monday/Tuesday. 

3.3 Delivery time is not guaranteed. Shipping and transit time estimates provided by Design 4 Nails or others should be considered merely as estimates. To avoid shipping or availability delays, we suggest ordering promptly.

3.4 Design4nails is not responsible for deliveries to incorrect addresses provided by customers. Please verify your address at checkout. Reshipping is available for an additional fee.

3.5 At “Design4nails,” we strive to provide fast and reliable delivery services to our customers. However, there may be instances where the courier is unable to deliver the order due to the customer being unavailable at the time of delivery.

In such cases, it is the customer’s responsibility to arrange for redelivery. If the customer fails to arrange for redelivery and the parcel is returned to us.

If customers would still like to receive their order, we can resend it to you, but an additional cost will apply.

We strongly advise customers to provide a correct and accessible delivery address and to make arrangements to be available to receive the delivery during the specified delivery time.

By placing an order with “Design4nails,” you agree to our shipping policy, and any additional costs incurred due to undelivered or returned packages will be the responsibility of the customer.

4. Deliveries

4.1 A flat fee of £5.4 is charged for DPD deliveries within the UK Mainland, with a delivery time of 1-3 working days. Heavier items (over 2kg) and deliveries outside the mainland will be shipped through alternative couriers such as UPS Standard or Evri with an additional fee.

4.2 Orders will be shipped in the order they are received. DPD targets delivery within 3 business days, but please allow 3-15 days for delivery attempts. We follow DPD guidelines and will not send a replacement until the delivery time has passed and a non-receipt declaration has been completed and submitted.

4.3 Design4nails reserves the right to replace any of the above services, without notice, for a similar or enhanced service, where we deem it to be more appropriate. 

4.4 If your package arrives damaged, you are protected by postal insurance. Do not accept the delivery and promptly contact us. We will make a claim for the damaged items and send a replacement. Refused deliveries with no signature will be returned to us. 

5. Returns/Claims

5.1 Unwanted items can only be returned if they are unused, unopened, and have not been tested. Electronic devices must be in their original, unused condition without any signs of use

5.2 Unwanted items must be returned within 14 days of delivery.

5.3 The buyer is responsible for the cost of returning unwanted items and will not be reimbursed by Design4nails. Shipping costs are not refundable, and only the cost of the product will be refunded.

5.4 In the unlikely event of receiving a damaged/defective, incorrect, or missing item (not advertised as damaged, unpackaged or without a lid), a customer must report the issue and provide photo or video evidence within 48 hours of receiving the item. Failure to do so within this timeframe will result in the claim not being accepted.

6. Refunds

6.1 Upon receipt of your return, Design4nails will issue a refund within 3-5 working days starting from the date your return is received.

6.2 Please note delivery charges are non-refundable, you will be refunded the cost of the product only. However, delivery charges will be refunded in the following cases:

• non-delivered item(s)
• damaged/defective item(s)
• incorrect item(s)

7. Missing orders

7.1 If your order has not been delivered or you believe it has been lost, please read the following and then contact us at info@design4nails.co.uk

 7.2 Please check your order this will indicate the date of dispatch, we can confirm all orders have left our building and proof of postage can be supplied.

• Standard UK Delivery takes 1-3 working days to arrive but may take longer than that.

7.3 If you haven’t received your order, please check your mail for a DPD card.

7.4 This would indicate that your parcel is at your local collection point awaiting collection.

7.5 Please check with your neighbors or check a safe place if you choose one.

7.5a By opting for a parcel to be left in a safe place or with neighbors you are deciding on the way it is to be delivered.

From that point on it is the customer taking the risk, not Design4nails. It is likely that, if the parcel has been delivered correctly on Design4nail’s end, we will not offer to replace the parcel.

7.6 Undelivered parcels must be reported within 7 days starting from the day your order has been placed. 

7.7 Couriers do not consider domestic orders (within the UK) lost until 15 working days have elapsed from the due date of delivery unless there is evidence to the contrary to demonstrate that the item has not been lost.

If the order can still not be located within 15 working days, we can send a replacement item or issue a refund.

8. Warranty

Returned items must be packed properly and safely, in the original packaging.

Items under warranty will be repaired or replaced with new or refurbished (if not possible to repair). Warranty repair may take up to 15 working days. We do not offer replacements during the repair process. 

The item(s) are returned at the buyer’s cost and the buyer will not be reimbursed for the cost by Design4Nails.

We may offer a full refund only if the item is not available or discontinued. 

8.1 All electronic devices sold by Design4nails come with a manufacturer’s warranty. The length of the warranty varies by product.

8.2 If a product is found to be defective within the warranty period, Design4nails will repair or replace the product, at its discretion.

8.3 The warranty does not cover damage caused by customer use or maintenance, accidental damage, or normal wear and tear:

• mechanical damage,
• liquid/dust damage,
• replacement of wearing parts (e.g. clutches, filters, bearings, spindles, commutators, brushes, fuses, bulbs, gaskets, accumulators, batteries),
• faults caused by overvoltage or overload of the electric network

8.4 Design4nails is responsible for defects resulting from hidden manufacturing or material defects of the goods. Stated during the warranty period, provided that:

• • the goods were used in accordance with their intended use, and the operating manual, and were properly maintained/cleaned.
  • the equipment recommended by Design4nails was used,
  • the goods have not been disassembled or modified by third parties not authorized by Design4nails,
  • work with the goods was not continued after the first symptoms of the defect appeared,
  • the serial number has not been damaged (e.g. removed, obliterated) to the extent that it cannot be identified, or the factory seal has not been removed.
  • the goods have not been overloaded due to excessive or improper use,
  • the goods have not been mechanically damaged, flooded with liquids, or dusty,
  • the holder of the guarantee did not know about the defect at the time of concluding the sales contract.

9. Limitation of Liability

9.1 Design4nails shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to lost profits, business interruption, or loss of data.

9.2 The total liability of Design4nails for any claim arising out of or relating to the products, or these terms and conditions, whether in contract, tort, or otherwise, shall not exceed the price of the products sol.

10. Governing Law

10.1 These terms and conditions shall be governed by and construed in accordance with the laws of England, without giving effect to any principles of conflicts of law.

11. Intellectual Property

11.1 The products, and all intellectual property rights, including trademarks, trade names, trade secrets, copyrights, patents, and other proprietary rights, are and shall remain the sole and exclusive property of Design4nails and its suppliers.

11.2 The customer shall not use or reproduce any of the intellectual property rights of Design4nails, except as expressly authorized by these terms and conditions.

12. Changes to Terms and Conditions

12.1 Design4nails may change these terms and conditions at any time, without notice. The customer is responsible for regularly reviewing these terms and conditions. The customer’s continued use of the products shall be deemed acceptance of the then-current terms and conditions.

13. Privacy

13.1 Your personal information, such as your name, email, address, and phone number,  is kept secure and confidential by us when you make a purchase on our site. This information is used for processing your orders, updating you on their status, and enhancing your shopping experience.

13.2 In order to keep you informed of the latest offers, we may send you notifications about current promotions, deals, and new arrivals on the “Design 4 nails” site. If you do not wish to receive these newsletters, you can easily unsubscribe by following the instructions in the emails we send to you.

13.3 Klarna

In order to be able to offer you Klarna’s payment options, we will pass to Klarna certain aspects of your personal information, such as contact and order details, in order for Klarna to assess whether you qualify for their payment options and to tailor the payment options for you.

14. Out-of-Stock Products

14.1 There may be times when the product you have ordered is out-of-stock which will delay fulfilling your order. We will keep you informed (via email or/and text message) of any products you have ordered that are out-of-stock and unavailable for immediate shipment. You may cancel your order at any time prior to shipping.

14.2 Design 4 nails reserved the right to cancel your order if we won’t hear from you within 48 hours.

15. Product Colours & Shades

Whilst we always strive to deliver product images that fully represent the nail art products we are selling. Colors and in particular pastel shades can and will ultimately appear slightly different to those represented on a VDU screen. This is due to the fact that no two computer monitor is set up the same and there will always be slight differences. Please be aware that the color of the products you are viewing may look ever so slightly different when you receive them. This is not viewed as a fault or reason for return.

16. Typographical Errors

Whilst we always do our best to be accurate mistakes can sometimes happen. In the event a product is listed at an incorrect price due to a typographical error or an error in pricing information received from our suppliers, our store shall have the right to refuse or cancel any orders placed for products listed at the incorrect price. Our Store shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your card/account charged. If your card/account has already been charged for the purchase and your order is canceled, we shall immediately issue a credit to your credit card account in the amount of the incorrect price.

17. Half-Price Items

Half-price sale items are not refundable and may have a short use-by date.

The following terms and conditions govern all use of the design4nails.co.uk website and all content, services and products available at or through the website (taken together, the Website). The Website is owned and operated by Design 4 Nails ("Design 4 Nails"). The Website is offered subject to your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies (including, without limitation, Design 4 Nails's Privacy Policy) and procedures that may be published from time to time on this Site by Design 4 Nails (collectively, the "Agreement").

Please read this Agreement carefully before accessing or using the Website. By accessing or using any part of the web site, you agree to become bound by the terms and conditions of this agreement. If you do not agree to all the terms and conditions of this agreement, then you may not access the Website or use any services. If these terms and conditions are considered an offer by Design 4 Nails, acceptance is expressly limited to these terms. The Website is available only to individuals who are at least 13 years old.

   By submitting Content to Design 4 Nails for inclusion on your Website, you grant Design 4 Nails a world-wide, royalty-free, and non-exclusive license to reproduce, modify, adapt and publish the Content solely for the purpose of displaying, distributing and promoting your blog. If you delete Content, Design 4 Nails will use reasonable efforts to remove it from the Website, but you acknowledge that caching or references to the Content may not be made immediately unavailable.

3. Payment and Renewal.
   • General Terms.
     By selecting a product or service, you agree to pay Design 4 Nails the one-time and/or monthly or annual subscription fees indicated (additional payment terms may be included in other communications). Subscription payments will be charged on a pre-pay basis on the day you sign up for an Upgrade and will cover the use of that service for a monthly or annual subscription period as indicated. Payments are not refundable.
   • Automatic Renewal.
     Unless you notify Design 4 Nails before the end of the applicable subscription period that you want to cancel a subscription, your subscription will automatically renew and you authorize us to collect the then-applicable annual or monthly subscription fee for such subscription (as well as any taxes) using any credit card or other payment mechanism we have on record for you. Upgrades can be canceled at any time by submitting your request to Design 4 Nails in writing.
4. Services.
   • Fees; Payment. By signing up for a Services account you agree to pay Design 4 Nails the applicable setup fees and recurring fees. Applicable fees will be invoiced starting from the day your services are established and in advance of using such services. Design 4 Nails reserves the right to change the payment terms and fees upon thirty (30) days prior written notice to you. Services can be canceled by you at anytime on thirty (30) days written notice to Design 4 Nails.
   • Support. If your service includes access to priority email support. "Email support" means the ability to make requests for technical support assistance by email at any time (with reasonable efforts by Design 4 Nails to respond within one business day) concerning the use of the VIP Services. "Priority" means that support takes priority over support for users of the standard or free design4nails.co.uk services. All support will be provided in accordance with Design 4 Nails standard services practices, procedures and policies.
5. Responsibility of Website Visitors. Design 4 Nails has not reviewed, and cannot review, all of the material, including computer software, posted to the Website, and cannot therefore be responsible for that material's content, use or effects. By operating the Website, Design 4 Nails does not represent or imply that it endorses the material there posted, or that it believes such material to be accurate, useful or non-harmful. You are responsible for taking precautions as necessary to protect yourself and your computer systems from viruses, worms, Trojan horses, and other harmful or destructive content. Design 4 Nails, design4nails.co.uk, the design4nails.co.uk logo, and all other trademarks, service marks, graphics and logos used in connection with design4nails.co.uk, or the Website are trademarks or registered trademarks of Design 4 Nails or Design 4 Nails's licensors. Other trademarks, service marks, graphics and logos used in connection with the Website may be the trademarks of other third parties. Your use of the Website grants you no right or license to reproduce or otherwise use any Design 4 Nails or third-party trademarks.
9. Advertisements. Design 4 Nails reserves the right to display advertisements on your blog unless you have purchased an ad-free account.
10. Attribution. Design 4 Nails reserves the right to display attribution links such as 'Blog at design4nails.co.uk,' theme author, and font attribution in your blog footer or toolbar.
11. Partner Products. By activating a partner product (e.g. theme) from one of our partners, you agree to that partner's terms of service. You can opt out of their terms of service at any time by de-activating the partner product.
12. Domain Names. If you are registering a domain name, using or transferring a previously registered domain name, you acknowledge and agree that use of the domain name is also subject to the policies of the Internet Corporation for Assigned Names and Numbers ("ICANN"), including their Registration Rights and Responsibilities.
13. Changes. Design 4 Nails reserves the right, at its sole discretion, to modify or replace any part of this Agreement. It is your responsibility to check this Agreement periodically for changes. Your continued use of or access to the Website following the posting of any changes to this Agreement constitutes acceptance of those changes. Design 4 Nails may also, in the future, offer new services and/or features through the Website (including, the release of new tools and resources). Such new features and/or services shall be subject to the terms and conditions of this Agreement.
    
14. Termination. Design 4 Nails may terminate your access to all or any part of the Website at any time, with or without cause, with or without notice, effective immediately. If you wish to terminate this Agreement or your design4nails.co.uk account (if you have one), you may simply discontinue using the Website. Notwithstanding the foregoing, if you have a paid services account, such account can only be terminated by Design 4 Nails if you materially breach this Agreement and fail to cure such breach within thirty (30) days from Design 4 Nails's notice to you thereof; provided that, Design 4 Nails can terminate the Website immediately as part of a general shut down of our service. All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
    
15. Disclaimer of Warranties. The Website is provided "as is". Design 4 Nails and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither Design 4 Nails nor its suppliers and licensors, makes any warranty that the Website will be error free or that access thereto will be continuous or uninterrupted. You understand that you download from, or otherwise obtain content or services through, the Website at your own discretion and risk.
16. Limitation of Liability. In no event will Design 4 Nails, or its suppliers or licensors, be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement for substitute products or services; (iii) for interruption of use or loss or corruption of data; or (iv) for any amounts that exceed the fees paid by you to Design 4 Nails under this agreement during the thirty (30) day period prior to the cause of action. Design 4 Nails shall have no liability for any failure or delay due to matters beyond their reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.
17. General Representation and Warranty. You represent and warrant that (i) your use of the Website will be in strict accordance with the Design 4 Nails Privacy Policy, with this Agreement and with all applicable laws and regulations (including without limitation any local laws or regulations in your country, state, city, or other governmental area, regarding online conduct and acceptable content, and including all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside) and (ii) your use of the Website will not infringe or misappropriate the intellectual property rights of any third party.
18. Indemnification. You agree to indemnify and hold harmless Design 4 Nails, its contractors, and its licensors, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorneys' fees, arising out of your use of the Website, including but not limited to your violation of this Agreement.
19. Miscellaneous. This Agreement constitutes the entire agreement between Design 4 Nails and you concerning the subject matter hereof, and they may only be modified by a written amendment signed by an authorized executive of Design 4 Nails, or by the posting by Design 4 Nails of a revised version. Except to the extent applicable law, if any, provides otherwise, this Agreement, any access to or use of the Website will be governed by the laws of the Leicestershire, UK, excluding its conflict of law provisions, and the proper venue for any disputes arising out of or relating to any of the same will be the state and federal courts located in Leicester, UK. Except for claims for injunctive or equitable relief or claims regarding intellectual property rights (which may be brought in any competent court without the posting of a bond), any dispute arising under this Agreement shall be finally settled in accordance with the Comprehensive Arbitration Rules of the Judicial Arbitration and Mediation Service, Inc. ("JAMS") by three arbitrators appointed in accordance with such Rules. The arbitration shall take place in Leicester, UK, in the English language and the arbitral decision may be enforced in any court. The prevailing party in any action or proceeding to enforce this Agreement shall be entitled to costs and attorneys' fees. If any part of this Agreement is held invalid or unenforceable, that part will be construed to reflect the parties' original intent, and the remaining portions will remain in full force and effect. A waiver by either party of any term or condition of this Agreement or any breach thereof, in any one instance, will not waive such term or condition or any subsequent breach thereof. You may assign your rights under this Agreement to any party that consents to, and agrees to be bound by, its terms and conditions; Design 4 Nails may assign its rights under this Agreement without condition. This Agreement will be binding upon and will inure to the benefit of the parties, their successors and permitted assigns.
