These Terms and Conditions (“Terms”) govern the use of the Design4nails LTD website (the “Website”) and the purchase of products from Design4nails LTD, a company registered in England and Wales under company number 11729184, with its registered office at 89 Bassett Street, Leicester, LE3 5ED (“Design4nails”, “we”, “us”, or “our”). By accessing the Website or placing an order, you agree to be bound by these Terms. These Terms comply with the Consumer Rights Act 2015, Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, and other applicable UK laws.

1. Ordering

1.1 Placing an Order: Orders can be placed via the Website by browsing our catalogue, selecting products, and adding them to your shopping cart. To complete your order, proceed to “Checkout”, provide accurate shipping and billing details, and select a payment method.

1.2 Order Confirmation: Upon successful payment, you will receive an order confirmation email. This email does not guarantee stock availability or delivery but confirms receipt of your order. We reserve the right to refuse or cancel any order at our discretion, including due to stock unavailability, pricing errors, or suspected fraudulent activity.

1.3 Accuracy of Information: You are responsible for providing accurate shipping and billing information. Orders delayed or declined due to incorrect details are your responsibility. Design4nails is not liable for losses arising from inaccurate information provided by you.

1.4 Fraud Prevention: To protect against fraudulent transactions, we may request additional verification (e.g., proof of identity or address) before processing your order. Failure to provide requested information within 48 hours may result in order cancellation.

2. Payment Methods

2.1 Accepted Methods: We accept payments via PayPal, Klarna, ClearPay, and card payments (Visa, Mastercard, and American Express). Payments are processed securely through third-party payment gateways.

2.2 Surcharges: We do not charge additional fees for standard consumer card payments. Any total amount payable, including product price, delivery charges and any applicable fees, will be clearly displayed at checkout before you place your order.

2.3 Currency: All payments are processed in British Pounds Sterling (GBP). Currency conversion fees, if applicable, are your responsibility.

2.4 Billing: Payment is usually taken at the time you place your order. If payment is not authorised or is declined, we will not be able to process your order.

2.5 Klarna Payments: If you choose Klarna’s payment options (e.g., Pay in 3), your personal information (e.g., contact and order details) will be shared with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, to assess eligibility and tailor payment options. Klarna’s privacy policy and terms apply, available at Klarna’s website.

3. Shipping Policy

3.1 Dispatch Time: Orders are dispatched within 2 working days of receipt, subject to payment clearance and stock availability. Orders placed on weekends or Bank Holidays are processed on the next working day. Orders placed after 11:00 AM on Fridays are processed on Monday or Tuesday.

3.2 Delivery Estimates: Delivery times are estimates and not guaranteed. Standard UK delivery via Royal Mail 24 Tracked typically takes 1-3 working days but may take up to 15 working days. Design4nails is not liable for delays caused by couriers or external factors (e.g., strikes, weather conditions). 

3.3 Incorrect Addresses: You are responsible for providing a complete and accurate delivery address. If an order is delayed, lost or delivered incorrectly because you provided an incorrect or incomplete address, we may not be able to offer a refund or replacement. If the parcel is returned to us, we can resend it to the correct address, subject to an additional delivery charge.

3.4 Undelivered Parcels: If a courier is unable to deliver because you are unavailable or you do not collect the parcel within the courier’s timeframe, the parcel may be returned to us. If this happens, we may cancel the order and refund the product cost, excluding the original delivery charge and any additional costs charged to us by the courier. Alternatively, we may offer to resend the order, subject to an additional delivery charge.

3.5 Safe Place or Neighbour Delivery: If you provide instructions for delivery to a safe place, neighbour, parcel box or other alternative location, you accept responsibility for the parcel once the courier records it as delivered in accordance with your instructions. If no such instruction was provided by you and the parcel is marked as delivered but not received, please get in touch with us so that we can investigate the matter with the courier.

4. Deliveries

4.1 Delivery Charges: A flat fee of £5.40 applies for Royal Mail 24 Tracked deliveries within UK Mainland (1-3 working days). Orders over 2kg or to non-mainland UK addresses (e.g., Northern Ireland, Scottish Highlands) are shipped via alternative couriers (e.g., UPS Standard, Evri) with additional fees, displayed at checkout.

4.2 Delivery Attempts: Couriers may attempt delivery multiple times. If delivery fails, the parcel may be left at a local collection point or returned to us. You are responsible for collecting or arranging redelivery.

4.3 Damaged Deliveries: If your parcel arrives damaged, do not accept delivery and contact us immediately at info@design4nails.co.uk with photographic evidence. We will file a claim with the courier and arrange a replacement, subject to postal insurance terms.

4.4 Service Substitution: Design4nails reserves the right to substitute delivery services (e.g., Royal Mail to UPS) with a comparable or enhanced service without prior notice.

5. Returns and Claims

5.1 Right to Cancel: Under the Consumer Contracts Regulations 2013, you have 14 days from the day after you receive your order to notify us that you wish to cancel your purchase. You then have a further 14 days to return the item to us.

Returned items must be unused, unopened, in their original packaging and in a resaleable condition. For hygiene and safety reasons, cosmetic products, nail products and liquids that have been opened, used, tested, or had their seal removed cannot be returned unless they are faulty, damaged or incorrectly supplied.

5.2 Return Process: To initiate a return, complete the Warranty/Return Form available on our Website and include it with your return. Return items to:

You are responsible for return shipping costs, which are non-refundable.

5.3 Condition of Returns: Returned items must be in their original, unused condition. Items that are used, opened, tested, or damaged by you will not be accepted for refund.

5.4 Defective or Incorrect Items: Claims for damaged, defective, incorrect, or missing items must be reported within 48 hours of receipt, with photographic or video evidence, to info@design4nails.co.uk. Claims reported after this period will not be accepted.

5.5 Non-Returnable Items: If a product is clearly marked as Short Date, Short Use-By Date before purchase, the customer accepts the stated remaining shelf life at the time of purchase. The product will not be considered faulty, defective or incorrectly supplied solely because of the expiry date or shelf life that was clearly disclosed before purchase.

5.6 Product Expiry Dates and Shelf Life: All products are supplied within their valid shelf life and are safe to use until the expiry date stated on the packaging. Expiry dates may vary by product, shade, collection, and batch. Products with less than 3 months of remaining shelf life may be marked as Short Date, Limited Shelf Life or Clearance and may be sold at a reduced price. Products with more than 3 months of remaining shelf life at the time of dispatch are not normally classified as short-dated and may be sold at the standard retail price.

The Period After Opening symbol, such as 6M, 12M or 24M, does not override the product’s expiry date. Products should always be used within their overall expiry date.

6. Refunds

6.1 Processing Time: Refunds for returned items are usually processed within 3–5 working days of receipt at our warehouse, provided the items meet the return conditions. In any case, refunds will be processed within the timeframe required by applicable law..

6.2 Refund Scope: If you cancel your entire order under your statutory cancellation rights, we will refund the product cost and the standard outbound delivery charge, where applicable. If you selected a more expensive delivery option than our standard delivery, we will only refund the cost of our standard delivery option. If you return only part of your order, the original delivery charge will not normally be refunded.

Return shipping costs are the customer’s responsibility unless the item is faulty, damaged, incorrect or otherwise supplied in breach of your statutory rights.

6.3 Method of Refund: Refunds will be issued to the original payment method where possible. If this is not possible, we will contact you to arrange an alternative refund method.

7. Missing Orders

7.1 Reporting Missing Orders: If your order has not arrived, contact us at info@design4nails.co.uk within 7 days of the expected delivery date. Provide your order number and dispatch confirmation details.

7.2 Investigation Process: We will provide proof of postage and track the parcel. Couriers do not classify domestic orders as lost until 15 working days from the expected delivery date, unless evidence proves otherwise.

7.3 Resolution: If the order is confirmed lost after 15 working days, we will issue a replacement or refund at our discretion. Orders left in a safe place or with a neighbour as per your instructions are considered delivered, and no replacement or refund will be offered.

8. Warranty

8.1 Manufacturer’s Warranty: Electronic devices come with a manufacturer’s warranty, the duration of which varies by product and is specified in the product listing.

8.2 Warranty Claims: Defective items under warranty will be repaired or replaced at our discretion. Contact us at info@design4nails.co.uk with evidence of the defect. Warranty repairs may take up to 15 working days.

8.3 Exclusions: The warranty does not cover:

  • Damage caused by misuse, neglect, or improper maintenance.
  • Mechanical, liquid, or dust damage.
  • Normal wear and tear (e.g., batteries, bulbs, gaskets).
  • Faults due to overvoltage, overload, or unauthorized modifications.
  • Items with removed or damaged serial numbers or factory seals.

8.4 Return Costs: You are responsible for the cost of returning warranty items. Repaired or replaced items will be shipped back to you at our expense.

8.5 Discontinued Items: If a defective item is discontinued or unavailable, we may issue a refund instead of a repair or replacement.

9. Marketing Communications

9.1 Consent: By placing an order, you consent to receive marketing communications from Design4nails via email, SMS, and WhatsApp about promotions, new arrivals, and order updates, unless you opt out.

9.2 Opting Out: You may unsubscribe from marketing communications at any time by:

  • Clicking the “unsubscribe” link in our emails.
  • Replying “STOP” to SMS or WhatsApp messages.

9.3 Transactional Communications: Order-related communications (e.g., order confirmations, dispatch notifications) are not considered marketing and cannot be opted out of while your order is active.

9.4 Compliance: Our marketing practices comply with the UK GDPR and the Privacy and Electronic Communications Regulations 2003. Your contact details will not be shared with third parties for marketing purposes without your explicit consent, except as required for payment processing (e.g., Klarna).

10. Limitation of Liability

10.1 General: Design4nails is not liable for indirect, incidental, special, or consequential damages, including lost profits, business interruption, or data loss, arising from the use of our products or Website.

10.2 Maximum Liability: Our total liability for any claim, whether in contract, tort, or otherwise, is limited to the purchase price of the products in question.

10.3 Statutory Rights: Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 or other applicable UK laws.

14. Out-of-Stock Products

14.1 Stock Availability: If a product is out of stock, we will notify you via email, SMS, or WhatsApp and provide an estimated restock date. You may cancel your order at any time before dispatch.

14.2 Order Cancellation: If we do not receive a response to our out-of-stock notification within 48 hours, we reserve the right to cancel the order and issue a full refund.

15. Product Colours and Shades

15.1 Colour Variations: Product images are for illustrative purposes. Due to differences in monitors and lighting, colours (especially pastel shades) may vary slightly from the product received. This is not grounds for return or refund.

16. Typographical Errors

16.1 Pricing Errors: If a product is listed at an incorrect price due to a typographical or supplier error, we reserve the right to cancel the order, whether confirmed or charged. If charged, a full refund will be issued immediately.
